There is no general private-sector data-localisation mandate in Hong Kong, and the PDPO’s cross-border transfer restriction (section 33) is not in force. So keeping AI data in Hong Kong is rarely a legal requirement for the private sector — it is more often a risk, procurement or contractual preference.

When residency matters anyway

Regulated buyers (banks under the HKMA, licensed corporations under the SFC), government-linked work, and contracts with residency clauses often require data to stay in Hong Kong by policy. And residency is separate from jurisdiction: a US-parented operator remains subject to the US CLOUD Act and FISA 702 regardless of region.

How to achieve it honestly

osFoundry’s managed cloud pins data to the US, EU or Japan — it does not currently offer a Hong Kong managed region (its nearest managed region is Japan). To keep data in Hong Kong, the honest path is self-hosting osFoundry (BYO Cloud) inside a Hong Kong cloud region such as AWS Asia Pacific (Hong Kong) ap-east-1, Microsoft Azure East Asia (Hong Kong SAR) or Google Cloud asia-east2 (Hong Kong), or running models locally on-device. For the strongest posture, pair Hong Kong-region residency with local-first processing and customer-held keys, and be precise about what residency does and does not guarantee.
